Terms and conditions
Last updated: 31 October 2026
1. Scope
These general terms and conditions (hereinafter “Terms”) apply to all orders and contracts concluded through the online shop labottegadelcaffe.ch.
The online shop is operated by:
Buon Caffè by Luca
Michelli Design
Limmatstrasse 50
8005 Zürich
Switzerland
[email protected]
+41 77 285 56 88
The range is primarily intended for customers resident or established in Switzerland. Deliveries are made to the delivery addresses selectable at checkout.
Consumers are natural persons who order predominantly for private purposes. Business customers (B2B) are natural or legal persons and partnerships ordering for their professional or commercial activities at the time the contract is concluded. The information provided and the identifiable purpose of the order at the time of contract conclusion are decisive; later business use alone is insufficient.
The version of these Terms published on the website at the time of ordering applies. Any differing customer terms apply only if we have expressly accepted them in writing.
2. Products and information
We aim to present current and accurate product details, images, prices, availability and delivery times. Product images are for illustration. Minor differences in packaging, colour, presentation or design are reserved, provided the essential product characteristics remain unchanged.
Availability and delivery time information is prepared carefully but is not a guarantee. Supply shortages, short-notice changes to the range, technical errors, obvious mistakes and printing or display errors are reserved.
Before ordering, customers must check the compatibility of machines, capsules, pods, accessories, power supplies and connections. A particular purpose or suitability is assured only if we have expressly confirmed it in writing based on complete information.
Installation and commissioning are owed only if expressly included in the offer. Customers must ensure suitable site conditions, particularly the required power and water supply, permitted water pressure, suitable water hardness and filtration, ventilation and ambient temperature. Where the manufacturer requires qualified personnel, installation must be carried out accordingly.
Preorders are possible only where a product is expressly offered for preorder. The stated availability or delivery time is an estimate unless a binding date has been guaranteed in writing.
Orders in quantities exceeding normal household use, orders with evidently incorrect details, and orders where there is reasonable suspicion of misuse or commercial resale may be refused or limited in quantity.
3. Prices, shipping costs and surcharges
All prices are stated in Swiss francs (CHF). Michelli Design is not liable for VAT and does not charge VAT.
Shipping costs, discounts, vouchers, any surcharges and the total amount are shown before the order is completed. The following shipping conditions currently apply to this shop:
- Express shipping “Priority”: CHF 9.00
- Free delivery: on goods worth CHF 50.00 or more
Thresholds refer to the value of the goods after discounts and vouchers, excluding shipping costs and surcharges. The calculation shown at checkout for the specific cart is decisive. Further information is available on the Shipping page.
In the event of obvious pricing errors or incorrect technical displays, we are not obliged to supply at the incorrect price. We will inform the customer and refund any payments already made if no contract is concluded at the correct price.
4. Ordering and contract conclusion
The presentation of products in the online shop is not a binding offer but an invitation to customers to place an order.
By submitting an order, customers make a binding offer to purchase the products in the cart. Before submission, products, quantities, billing and delivery addresses and other entries can be checked and corrected in the cart and at checkout.
An order confirmation is automatically sent by email after the order is received. It confirms receipt of the order but does not yet constitute acceptance of the offer.
The contract is concluded only when we expressly accept the order, confirm dispatch or deliver the goods. Until then, we may reject all or part of the order, particularly in cases of unavailability, incorrect or delayed stock data, duplicate sales caused by a system or synchronisation fault, obvious pricing or description errors, outstanding payment, a failed security check or reasonable suspicion of misuse.
If unavailability is discovered only after the contract is concluded, we will inform the customer without delay. A longer waiting period or substitute product will be agreed only with the customer’s consent. If delivery is permanently impossible, we may withdraw from the unfulfillable part of the contract to the extent permitted by law. Payments already made for undelivered goods will be refunded using the original payment method. Mandatory statutory claims remain reserved.
5. Payment
The payment methods displayed during ordering are selectable subject to availability. Depending on the shop and selection, payment processing is handled in particular through Payrexx (including TWINT and the cards offered), Stripe, PayPal, HeyLight and bank transfer, where the respective method is offered at checkout. There is no entitlement to a particular payment method.
Payments must be made in Swiss francs (CHF). With credit cards, TWINT, PayPal or other instant payment methods, the amount may be charged when the order is placed or immediately afterwards. If no contract is concluded, any amount already charged will be refunded.
For advance payment, dispatch takes place only after full payment has been received. For purchases on invoice, the invoiced amount must be paid within the specified period without deductions. Payment service providers may apply their own terms of use, security and privacy conditions.
The advance-payment reservation period displayed at checkout is a maximum of 4 calendar days (96 hours) from receipt of the order. We must receive the full amount within this period; initiating a bank transfer is not sufficient. The exact deadline is stated in the payment instructions. If payment is not received on time, an order that has not yet been accepted is cancelled at the deadline and the reservation is released. A late payment does not automatically reactivate the order or authorise delivery. We clarify it with the customer and refund it if no new delivery agreement is reached. A reservation in the shop is neither a binding reservation with the supplier nor a delivery guarantee. We check availability again before authorising delivery. In the event of unavailability, section 4 and its duties to inform, obtain agreement and refund apply. For orders already accepted, the statutory requirements and section 6 apply; mandatory rights remain reserved.
6. Late payment
If a customer is late with a payment that is due, we may issue reminders for outstanding amounts, withhold further deliveries and withdraw from the contract after an unsuccessful additional payment period. Reasonable reminder, chargeback and collection costs actually incurred may be charged to the extent permitted by law.
Outstanding claims may be referred or assigned to third parties for collection to the extent permitted by law.
7. Delivery
Delivery is made to the address entered by the customer at checkout and accepted by the shop. Customers are responsible for complete and correct details and for the accessibility of the delivery address.
Our products may be dispatched from multiple warehouses at different locations in Switzerland. Warehouse allocation, internal transfers, differing availability and partial deliveries may therefore result in different processing, dispatch and delivery times within the same order. Partial deliveries are permitted where reasonable and do not incur additional shipping costs.
Stated delivery times are based on the stock and transport situation known at the time of ordering and are estimates unless a binding delivery date has been expressly guaranteed. To the extent permitted by law, a reasonable overrun of a non-binding estimate does not, by itself, give rise to a claim for compensation, a price reduction or termination of the contract.
In the event of delays caused by warehouse allocation, transfers, manufacturer supply shortages, carriers, force majeure, official measures, operational disruptions or other circumstances beyond our reasonable control, the delivery period will be extended appropriately. Mandatory statutory rights and delivery dates expressly guaranteed in writing remain reserved.
If a shipment cannot be delivered because of incorrect address details, failure to collect, refusal of delivery or other reasons attributable to the customer, the documented additional costs of return, storage and redelivery may be charged.
8. Inspection and notification of defects
After receipt, customers must inspect the delivered goods as soon as possible in the normal course of business for correctness, completeness, transport damage and apparent defects.
Incorrect or incomplete deliveries, visible transport damage and apparent defects must be reported by email as soon as possible, and no later than five calendar days after delivery, to [email protected]. The notification should include the order number, an accurate description and suitable photos or other evidence.
Hidden defects must be reported immediately after discovery. Goods must be retained until the matter is clarified. Returns may be made only after our prior written confirmation and in accordance with the return instructions provided. Unsolicited returns or goods disposed of without instructions may hinder inspection and processing; mandatory statutory rights remain reserved.
9. No voluntary right of withdrawal, return or exchange
Swiss law provides no general statutory right of withdrawal or return for ordinary online purchases. We therefore grant no voluntary right of withdrawal, return or exchange for correctly delivered, defect-free goods. Orders are binding after the contract is concluded. Dislike of a product, an incorrect choice by the customer or a later change of mind does not create a right to return, exchange or refund.
Any goodwill arrangement exceptionally approved in writing is voluntary, without acknowledgement of a legal obligation and without effect on other cases. Goods sent without prior written approval may be refused.
Customers bear the costs and risk of an approved goodwill return, except in cases of confirmed incorrect delivery or a defect attributable to us. Opened food, coffee, capsules, pods, hygiene items, customised products and damaged, used or incomplete goods are excluded from goodwill arrangements. Mandatory statutory rights relating to defects remain reserved.
10. Cancellations
There is no entitlement to cancellation after the contract is concluded. If we exceptionally agree to cancellation in writing, payment, processing, shipping, return and storage costs already incurred and documented, as well as any loss of value, may be deducted from the refund.
We reserve the right to refuse or cancel an order, particularly because of unavailability, obvious pricing errors, outstanding payment, a failed security check or suspected misuse. Payments already made for undelivered goods will be refunded.
11. Statutory warranty and guarantees
For proven defects reported in time, applicable Swiss law and the following provisions apply. For new goods sold to consumers, the statutory limitation period for warranty claims is generally two years from delivery. No reduction of mandatory statutory periods is intended.
For sales contracts between businesses (B2B) where the machine is intended for the buyer’s professional or commercial activities, the limitation period for material defects in new machines is reduced to twelve months from delivery to the extent permitted by law. This reduction does not apply to consumer contracts. The intended purpose at contract conclusion is decisive, rather than the type of machine alone or subsequent business use.
For goods expressly offered as used, second-hand, demonstration or display items, the limitation period for consumers is reduced to one year from delivery to the extent permitted by law. Clearly disclosed signs of use, operating hours, meter readings and known deviations form part of the agreed condition and do not constitute a defect.
To the extent permitted by law, defects will initially be remedied by repair or replacement at our discretion. If the chosen solution is impossible, disproportionate or cannot be implemented within a reasonable time, price reduction, reversal of the transaction and further claims are governed by applicable law.
Defects do not include, in particular, normal wear, wearing parts, age-related or usage-related wear, or damage caused by improper use, unsuitable site or connection conditions, incorrect cleaning or descaling, absent or inadequate maintenance, limescale, dropping, moisture, frost, power surges, unauthorised intervention, unsuitable accessories or unsuitable consumables.
Warranty cases must be reported in writing before any return, with the order number, a description of the fault and suitable photos or videos. For machines, the model, serial number, purchase date, displayed error codes and operating conditions must also be provided where this information exists and is reasonably accessible.
Before a return, customers must cooperate with a reasonable and safe preliminary diagnosis. This may include reading error codes, restarting, checking connections and safe cleaning or descaling steps following our instructions. Opening the machine or other dangerous interventions or work requiring unreasonable technical expertise is not required.
Where the cause of a defect may relate to maintenance, cleaning, descaling or the intensity of commercial use, available maintenance, cleaning and descaling records and evidence of service work must be submitted on request. Missing records do not automatically remove mandatory statutory rights, but may hinder technical assessment and identification of the cause.
Goods may be dispatched only after our written confirmation and in accordance with our return instructions. An approved return must be adequately cushioned in the original packaging or equivalent packaging suitable for transport. Customers bear damage and documented additional costs caused by insufficient packaging, unauthorised returns, carriage-forward shipments or failure to follow the return instructions. For a confirmed warranty case, we cover the necessary costs of the return we have instructed; if inspection finds no defect attributable to us, reasonable inspection and transport costs may be charged after prior notification, to the extent permitted by law.
For food and consumable products such as coffee, capsules and pods, no voluntary shelf-life or taste guarantee is provided beyond statutory or expressly assured product characteristics.
The statutory warranty for defects is a claim against us as the seller and exists independently of any voluntary manufacturer’s guarantee. A manufacturer’s guarantee does not restrict mandatory statutory claims against us.
A voluntary manufacturer’s guarantee is a separate undertaking by the manufacturer or guarantor named in the guarantee document. Its scope, duration, exclusions and processing are governed solely by the relevant guarantee conditions; claims may need to be handled directly through the manufacturer or a designated service centre. A manufacturer’s guarantee does not extend our statutory obligations as the seller.
The manufacturer’s operating, care, cleaning, descaling and safety instructions must be followed. In the event of a safety warning or recall, use must be stopped immediately where required, and customers must cooperate with the specified process.
12. Repairs outside warranty or guarantee
Repairs outside a recognised statutory warranty or guarantee case are carried out only by prior agreement. Customers may be charged for inspection, estimates, labour, spare parts, packaging and shipping.
If an estimate is rejected or not answered within the specified period, the product may be returned at the customer’s expense.
Repaired or inspected products must be collected or released for return within the specified period. After a reminder and a reasonable additional period, previously announced, documented storage costs and return shipping costs may be charged. Disposal, realisation of value or transfer of ownership does not occur automatically, but only under an express agreement or a legal basis.
13. Vouchers, discounts and promotions
Vouchers, discount codes, loyalty benefits and promotions are valid only for the stated period and under the published conditions. They may be restricted to specific products, customer groups, quantities or minimum order values and generally cannot be combined.
Cash payment, interest and retrospective application are excluded unless mandatory law or an expressly published condition provides otherwise. When reversing a defective delivery, no more than the amount actually paid will be taken into account.
14. Liability
We are liable without limitation for damage caused intentionally or through gross negligence. In cases of slight negligence, we are liable, to the extent permitted by law, only for direct and foreseeable damage arising from a breach of essential contractual obligations. Otherwise, liability for slight negligence, indirect damage, consequential damage, lost profits and data loss not caused by us is excluded.
To the extent permitted by law, no liability is accepted for damage caused by improper use, failure to follow operating, care, safety or descaling instructions, or the use of unsuitable products or accessories.
Mandatory statutory liability, particularly for personal injury and damage caused intentionally or through gross negligence, remains unaffected. We accept no responsibility for the content of external websites linked from the online shop.
15. Privacy
We process personal data relating to website visits, customer accounts, orders, payments, delivery, communication and defect and warranty cases in accordance with applicable Swiss data protection law and our separate privacy policy.
To process an order, necessary data may be shared in particular with payment providers, shipping and logistics partners, hosting and IT service providers, accounting, advisers, collection agencies and public authorities, where required for contract performance, operation, security, enforcement of rights or statutory obligations.
To document contract conclusion with minimal data, we store only the identifier of the accepted version of the Terms and its technical checksum in the order record. The complete Terms are not stored again for every order, but centrally archived once per version. This creates no additional customer or profile data beyond the order data already required.
16. Retention of title
Delivered goods remain our property until paid for in full. We are entitled to register retention of title in the relevant register at the customer’s expense where provided for by law or necessary to secure the claim.
17. Changes to the Terms
We may amend these Terms at any time for future orders. An order is governed by the version published and accepted by the customer at the time it is concluded. Later changes do not apply retrospectively to contracts already concluded unless mandatory law requires otherwise.
Each published version of the Terms receives a unique version identifier including the shop and language and is centrally archived. Only this identifier and the technical checksum of the accepted version are stored in the order record. Together with the existing order timestamp, this allows the applicable Terms to be demonstrated later without duplicating the full text for every order.
18. Partial invalidity
If any provision of these Terms is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected. The statutory rule applies in place of the invalid provision. The same applies to unintended gaps.
19. Applicable law and jurisdiction
All legal relationships are governed by substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
To the extent permitted by law, jurisdiction lies at the seller’s registered office. Mandatory statutory venues, particularly consumers’ rights to choose a venue, are expressly reserved.
